THE CALIFORNIA EVICTION PROCESS


Below is a general outline of the eviction process. Please note all of these steps may be involved or only one or two of them. It depends on the actions of the tenant. Each step is crucially important and a mistake can end or prolong the process.

Notice


If you want to evict your tenant, you must first provide them with written notice. Depending on the type of lease they have, you will need to give them either 3, 30, 60, or 90 days notice.

File a Complaint


If the tenant fails to respond, you may then file an Unlawful Detainer complaint along with accompanying documents and service.

Obtain a Default


If the tenant does not respond, then you can claim a Default Judgement and obtain a Writ of Possession. Take the filed Writ to the local Sheriff’s Department. The Sheriff will serve the Tenant with a Notice to Vacate.

Trial


If the tenant does respond, then you must request a day for trial where the judge will consider each parties’ claims. If the judge agrees with you, then you will similarly obtain a Writ of Possession and have the Sheriff evict the tenant if they fail to move out.
